Terms of use

Introduction

Each person, called “User”, who received access to the website http://www.betp.bg, hereinafter referred to as “the site”, and to the information and services offered by the “Bulgarian Energy Trading Platform” AD (BETP), agrees and accepts to comply with these General Terms of Use. These conditions have the character of an agreement between BETP AD and the consumers. By using the site or its services, Users confirm that they have read the rules and agree to all the General Terms. In case the Users do not agree with the General Terms, they should not use or access the site and / or its services. The agreement is in force until its termination.

General terms of use

  1. Rights and obligations:

The User  has the right to use this site, as well as the information and materials contained in it, only for purposes permitted by law, without prejudice to the rights and restrict access to this site to third parties.

The use of the site is at the initiative, desire and expense of the User , subject to the restrictions in the Copyright and Related Rights Act in favor of the copyright holder – BETP AD or a third party.

The User  has the right to view, store, copy and print the materials from this site only for personal use in order to be informed about the services offered by BETP AD and / or to place orders or request offers regarding the services on the site.

The User  has no right to change, copy, reproduce (in whole or in part), publish, send (in any way), borrow, sell, create secondary materials based on the content on the site, use for commercial purposes or distribute on in any other way any element of the content of this site without the prior written permission of BETP AD.

The User  is not allowed to use the site to gain unauthorized access to other computer systems or networks.

BETP AD reserves the right to update (add, change, move and delete) the content of the site or parts of it, by changing, adding, deleting information related to the site, possibly to correct errors, inaccuracies and omissions at any time without prior notification. The use of the site, after making changes to the Terms of Use, will be considered as consent of the Users to these changes.

  1. Discontinuation of use

BETP AD may terminate or suspend the use by User s of the site, the services provided and the content at any time and at its discretion, even if access and use continue to be permitted for others. When stopping or terminating the use of the site, Users must stop using the site, and destroy all copies made of any part of the content. BETP AD is not responsible to Users or any third party for termination or suspension of access to the site, services and its content.

  1. Limitation of liability

BETP AD has taken all necessary measures regarding the reliability, truthfulness and completeness of the information on the site, as well as the absence of misleading data. Despite the above, BETP AD does not assume any guarantees regarding the accuracy and completeness of the content on the site. The full content of the site is provided “as is”.

The use of the site, as well as the actions that the User  takes as a result, are the sole responsibility of the User .

BETP AD, its employees, directors, suppliers or other third parties, BETP AD are not liable for any damages (including, but not limited to, direct, indirect, punitive, special, incidental, caused, consequential damages, damages from missed benefits, loss of information or interruption of activity or others) caused in any other way related to or resulting from the use, inability to use or lack of access to the site or material published on it, as well as the handling with it (including technical problems, regardless of the efforts made by the Provider) or on other sites to which this site links, as well as other materials, information, products or services contained in some of these sites, regardless of the grounds and lack of warning of the possible occurrence of damages and even when the Supplier has been notified of the likelihood of such damage. Apart from the above, the liability of BETP AD is limited to the maximum permissible degree provided for in the Bulgarian legislation.

The costs and responsibilities in connection with the use of the site, including but not limited to fees for delivery and provision of Internet connection, mobile Internet access, service and others are borne by the User . BETP AD does not owe the User  any amounts in connection with any costs for the use of the site, as the company, its representatives and employees are not liable for any claims for damages.

  1. Links to other sites

It is possible that the site has hyperlinks to websites that are provided only for the convenience of Users and are owned by third parties and BETP AD is not responsible for them.

Using the links, the User  is aware that he leaves this site and in this case BETP AD is not responsible for access to these external sites, as well as for their content, completeness, timeliness, accuracy and usefulness of information, advertisements, products or other materials that became available on or through them. BETP AD is not responsible for the policy regarding the protection of personal data or the security of these sites. Their use is the sole responsibility of the User .

Links from third pages to the site are permissible if made in an appropriate context, and must not contain content that is contrary to law or defamatory, has discrediting, obscene, threatening content or constitutes an infringement of personal or public rights or is inappropriate for any way of publishing.

BETP AD has the right at any time to remove any information sent by a User . With regard to the materials provided by a User , in connection with which claims have been filed against the User  who provided them, BETP AD is released from liability.

  1. Copyright

The copyrights regarding the design, structure and content of the site are the property of BETP AD, which has the exclusive right to use them. Any unauthorized use of the content is a violation of copyright or other legal provisions.

All rights to materials, texts, publications and applications on the site are the property of BETP AD and are protected by the Copyright and Related Rights Act. All images, documents and applications, as well as all other materials on the site are the property of BETP AD or in respect of them are provided the necessary permits for their publication and distribution.

This site may contain materials, names or trademarks owned by other companies, organizations and associations protected by the Copyright and Related Rights Act (CRRA).

  1. Confidentiality

BETP AD guarantees the inviolability of all personal data, including, but not limited to, the User’s name and / or email address. They will only be used for the purposes for which they were collected or received and will not be made available to third parties.

Personal or identification data will not be used for any other purpose without the express written consent of the User, except in cases provided by law. BETP AD will not use the received information to send unsolicited messages (spam).

BETP AD is not responsible for the personally identifiable information that the User  discloses to other sites by using the links to them located on the site.

The information provided by the User  when visiting this site is used to provide services, respond to inquiries, improve the site, to communicate with Users, for marketing and information purposes, to accept requests and send services to Users and more.

  1. Integrity of the agreement

These General Terms of Use represent the full Agreement between BETP AD and the user regarding the use of the site and the services provided through the site and cancel all preliminary discussions and subsequent agreements concerning its subject.
